Automatic vs. Recorded Homestead Declaration
Nevada provides two types of homestead protection:

Key Rules for the Nevada Homestead Exemption in Bankruptcy
- Opt-out state: Nevada debtors must use state exemptions. Federal exemptions under Section 522(d) are not available.
- Domicile requirement: You must have been domiciled in Nevada for at least 730 days (2 years) before filing. If not, the $189,050 federal cap from Section 522(p) may apply.
